Seminar on The Coordinated Development of Anti-monopoly and Protection of Intellectual Property was Held Successfully at Renmin University

On July 3rd, 2015, the seminar on the
coordinated development of anti-monopoly and protection of intellectual
property was held in Room 601 of Mingde Law Building. This meeting was
co-hosted by Renmin University of China – Korea University China-Korea Market
and Regulation Law Center and Shanghai Jiaotong University Competition Law and
Policy Research Center. Many leading experts from the State Administration for
Industry and Commerce, China University of Political Science and Law, Chinese
Academy of Sciences, Renmin University of China and Shanghai Jiaotong
University were invited to deliver a speech. Nearly one hundred elites from
government sectors, research institution, colleges and universities, law firms
as well as Chinese and overseas companies participated in this conference. They
had a heated discussion on the topic of the coordinated development of
anti-monopoly and protection of intellectual property.
The seminar began at 2:00 pm. Meng Yanbei,
the Associate Professor of Renmin Law School and Chinese Executive Director of
China-Korea Market and Regulation Law Center chaired the brief opening
ceremony. She introduced all the participants, and extended her sincere thanks
and warm welcome to the representatives of different fields who paid close
attention and participated in this meeting.
Afterwards, the presentation of the first
unit of the meeting was started. First, Deputy Director General Lu Wanli from
the State Administration of Industry and Commerce delivered a keynote speech.
He introduced the background, significance and contents of the Provision on the
Prohibition of Abuse of Intellectual Property Rights to Eliminate or Restrict
Competition (the “Provision”). Deputy Director General Lu recalled the
progressive development of the “Provision” with a clear sequence of thought. As
a witness to the provision, he shared his views on the content, significance
and how to coordinate the development of anti-monopoly and protection of
intellectual property in the process of competition law enforcement.
Professor Shi Jianzhong, the vice president
of China University of Political Science and Law as well as the expert advisory
group member of the Anti-monopoly Commission of the State Council, made a
further analysis of the relationship between anti-monopoly and protection of
intellectual property by taking the example of patent law and anti-monopoly
law. Professor Shi Jianzhong stressed that the enforcement purpose of
anti-monopoly law is the prevention and suppression of monopolistic behaviors,
rather than the elimination of the monopoly, which represents that the purpose
of anti-monopoly is to protect the environment for innovation, moreover, it is
the same thing with the protection of intellectual property, and these views
stroke a chord with the participants.
Then, Professor Wu Hanhong of Renmin
Economics School, who is also the expert advisory group member of the
Anti-monopoly Commission of the State Council, gave a speech from the
perspective of economics by introducing the “trade-offs” and “efficiency” these
two basic concepts. His rich professional knowledge and humorous language had
won warm responses.
The second unit of the meeting was held by
Secretary General Shang Lina of Shanghai Jiaotong University Competition Law
and Policy Research Center, and four specialists and scholars delivered their
keynote speeches.First, Post-doctor Han Wei from Chinese Academy of Sciences
made a detailed introduction of the legal analysis procedure with the legal
analysis framework of anti-monopoly in the field of intellectual property. He
laid a particular emphasis on the great influence of the stability and
flexibility of analysis steps on the coordinated development of anti-monopoly
and protection of intellectual property rights.
Second, Meng Yanbei, the Associate Professor
of Renmin Law School and Chinese Executive Director of China-Korea Market and
Regulation Law Center made an analysis of the legal regulation problems in the
standard drawing-up and practicing process combined with cutting-edge topics,
which inspired the audience.
Third, Executive Director Professor Li Jian
of Shanghai Jiaotong University Competition Law and Policy Research Center gave
a speech on the anti-monopoly regulation of tied sale in the field of
intellectual property rights. He believed that focus of the related research
should go back to the basic issue of “single product”, which showed his
profound knowledge of the tied sale issue.
Finally, Deputy Director Associate Professor
Hou Liyang of Shanghai Jiaotong University Competition Law and Policy Research
Center gave a wonderful speech on the issue of safe harbor and refusal to
license in the intellectual property rights and anti-monopoly regulation.
After the keynote speech, Professor Wang
Xianlin, who is Executive Vice-President of Shanghai Jiaotong Law School and
the expert advisory group member of the Anti-monopoly Commission of the State
Council made a brief summary. He said that this seminar had fully reflects the
community’s concern on the theme of the coordinated development of
anti-monopoly and intellectual property protection. Professor Wang Xianlin
extended sincere thanks to the speakers and the participants, and hoped that
the coordinated development of anti-monopoly and intellectual property
protection will have a brighter future with the common efforts. This seminar
ended successfully in the warm applause.
