  • The First Working Conference of MRLC Annual Report was Held in Renmin University of China

    On December 23rd, 2014, the first working conference of China-Korea Market & Regulation Law Center (MRLC) Annual Report was held in Renmin University of China. This conference was hosted by Associate Professor Meng Yanbei of Renmin Law School. Professor Liu Chuntian, Professor Guo He, Professor Li Chen, Associate Professor Wang Chunyan, Associate Professor Jin Haijun, Associate Professor Zhang Guangliang and Doctoral student Dong Dudu from Renmin Law School, Lecturer Tan Yuan from China Youth University of Political Studies Law School and Lawyer Adrian (Meng Ji’an) from Hogan Lovells Law Firm attended this conference.

     


    The working conference mainly involved the discussion on outline, content, writing requirements, schedule and other issues of 2014 MRLC Intellectual Property Law and Competition Law Annual Report. Professor Liu Chuntian emphasized that intellectual property is closely related with technology development, business model and corporate management. Besides, technological progress coordinates well with institutional development, and technological development reflects the trend of a country’s economic development, therefore, publishing the Intellectual Property Law and Competition Law Annual Report is beneficial for the country, and is of great significance for the international community to have a better understanding of China. In the meantime, Professor Liu suggested that the annual report should concisely indicate the development of intellectual property law and competition law in China and Korea, and during the writing process, improve the parts which need to supplement. Furthermore, the annual report should be supported by relevant data as well as should be persuasive. At the same time, the report should have both description and comments.


     


    Associate Professor Meng Yanbei gave an introduction to specific arrangements for MRLC annual report. Firstly, the purpose of MRLC Annual Report is to introduce China’s legislation and major cases of intellectual property law and competition law in 2014 to the world from an objective and neutral standpoint. Meanwhile, try to keep writing the annual report every year in accordance with the style and mode of 2014. Secondly, MRLC annual report involves main body and two annexes, and every part consists of overview, legislation and policy development as well as major cases. Thirdly, after finalizing the report, the annual report will be translated into English and Korean, moreover, it will be published in Chinese, Korean and English. The annual report is planned to be published before June 2015.

     



    Afterwards, teachers put forward their own ideas and opinions on specific problems in the process of report writing. They had a fierce discussion on the number and time limit of cases selected, as well as the content of relevant legislation of annual report, and ultimately reached consensus on these issues. Firstly, the number of everyone’s cases selected is five at most, and except special circumstances, the time limit of cases selected is from January 1st, 2014 to December 31st,2014, furthermore, it is preferred to make a brief introduction to the cases occurred before that period. Secondly, during the process of selecting cases, pay attention to the parts that may have overlapped cases, for instance, the cases of anti-monopoly and patent may overlap, so everyone need communicate and coordinate with each other during the process of writing the report. Thirdly, pay close attention to the trends of relevant legislation, and the legislation selected includes the revision of law, the promulgation of matched regulations and judicial interpretation; moreover, it also includes exposure drafts of laws and regulations.


     


    In the end, Professor Liu Chuntian made a concluding remark on this annual report conference, and hoped that the teachers can carry out their writing tasks as soon as possible. It is  preferred that the first draft of MRLC annual report can be completed before the end of January 2015, and everyone should keep communication with others during the process of writing. Furthermore, he hoped and believed that MRLC Intellectual Property Law and Competition Law Annual Report can be completed with high quality.
